I filed for 485 during July 2007. My 140 was already approved. Due to some problems I quit my employer in August 2007. My previous employer was a desi blood sucker. I was fed up & decided to quit after working for him for 3 years. I applied for H1 transfer with a new employer based on approved 140. I got H1 approval for another 3 years. Currently I am working for the new H1 sponsoring employer. I also received an EAD card based on pending 485 for one year. I didnt notify USICS of job change in July.
I applied for EAD extension this year. The application for EAD extension is pending. I got a following RFE on my 485:
Please state whether or not you are currently working for your I-140 petitioner.
You must submit a currently dated letter from you permanent employer, describing your present job duties & position in the organization, your proferred position (if different from your current one), the date you began employement & the offered salary & wage. The letter must also indicate whether the terms & conditions of your employement based visa petition (or labor certification) continue to exist.
I am not in good terms with my previous employer so I cant ask him for a letter. I can ask my new employer for such a letter.
Will USCIS come to know I quite Employer A before completing 180 days?
Also is it possible that 140 was revoked by my previous employer?
What document should I send to USCIS now?
Nowhere in this post, do I see the fact that the OP used AC21 when he moved in August 2007.
Does not AC21 come in when you have used EAD to move instead of a H1 transfer?
In my understanding, by doing a H1 transfer rather than invoking AC21, the OP preserved the status of the original petition unless the employer revoked the I140 for fraud. If that's the case, shouldn't the RFE be worded differently?
If that's not the case, all the OP has to do is craft a response to the RFE with an Employment Verification Letter from his current employer attesting to the similar nature of job etc.. and move forward.
Either way, an attorney would be the safest bet..

I never wrote dirty linen is "writing the fact that we have to wait for years and years" or "having the poll" either. singhsa3 is trying his best to make a case that all of us who are "waiting for years and years" have the potential to buy houses, and therefore give us GCs. Dirty linen is when people like me and Pegasus503 offer our contrasting views (and get red-dotted by immature posters who cannot have a civil debate) AND the media thinks these IV folks are not even in agreement on this subject. This to me would be detrimental to singhsa3's efforts and thus I wrote let's not bicker/argue/wash dirty linen about whether we agree with singhsa3's idea or not.
As far as your advice "if you are not convinced then stay out of the way", take a cold shower, dude. I was the first to delete my post and asked others to do the same so this would benefit singhsa3's campaign. If your miniscule brain cannot fathom my posts, ignore them and help singhsa3 out instead. (1) The six-year visas allow foreign workers to bring in their families, and guarantee thousands of anchor babies.

(2) H-1B salaries are tax-exempt - no FICA, no federal or state income taxes. They can live at the same level as tax-paying Americans at a lower cost. Therefore, Congress allows foreigners to "low-ball" American workers.
You people eat on the taxes that we pay and leave once our 6 years are compelte. Can you show where and how the H1B's are tax exempt.
(3) H-1Bs can leave the job they came to fill and seek other jobs, not necessarily in the "hard to fill" category.
H1B's cannot take any job as they like first they have to get the H1 processed by that company that is willing to employ them. If you don't know how H1B works then educate your self by going thru the requirements for the H1B.
(4) Most H-1Bs are of a "protected" ethnic group, so H-1Bs have an affirmative action preference when competing with Americans for the same jobs.

No more crossing into USA just based on saying you are a Citizen (oral declaration).
Starting from January 31, 2008 (two weeks from now), all citizens must carry passport or other kinds of acceptable ID's to enter into US border. This is also applicable US and Canadian citizen.
Following are acceptable documents/ID's for US/Canada citizens ages 19 and older.
1. USA, Canada passports
2. US passport card (available in the spring)
3. Trusted traveler card such as NEXUS, SENTRI or FAST
4. Secure driver's license
5. US military ID
6. US Merchant Mariner document
7. One of several IDs issued to Native Americans
So, proof of citizenship will be required for entry.
As usual, all other citizen must carry all required documents.

Taking a benefit of one group, then distribute the pain across the board is not fair to ROW applicants. This is not the solution. You cannot say to us ROW people that we don't understand the fustration of waiting for our GC as well.
I think its ridiculous that some family takes up to 4 GC from the EB GC pool, why don't you make a petition to state that only EB GC goes to EB primary applicant while your family takes up family based GC. Unless your wife and kids are hired to work as the rest of us, them taking EB based GC is unfair to the rest of us who don't have a family.If you petition to eliminate country EB GC only to the primary applicant, then fine....i am all for it, but if you add your wife and kids to it, i say no.
If you call it re-distribution of pain, I would call it sharing the pain. I think its high time ROW candidates felt the pain which we non-ROW have suffered for a long time. You are objecting just because you are on the better side and wish to continue with the better bargain. If you think about it as a EB group in general, then its absolutely ridiculous that there should be country limits for EB category GC when there is no limits on H1B which is the primary route for most EB category GC applications. I completely agree with you on the family quotient of your arguement, they should not get the GC numbers which is meant only for primary EB applicant. Not that I want families to suffer, but the family GC numbers for EB applicants should not count towards GC number cap.

Where does it say in the bulletin that it will move in the next bulletin?

Guys,
Lets have a conference call today to finalize the flyer. I have some comments/questions on the updated flyer. Its better we do this over the phone so that we don't waste time in these posts back and forth. If everyone is OK, I will schedule a call for tonight at 10.30 PM as I have class.
Let me know if that works for you guys or if it is too late, then we can have it tomorrow at Noon.

Lord Ganesha picture on the India Pale Ale is a warning symbol. It means that if you drink too much beer, do not exercise, and use mouse as your vehicle then your belly will be as big as Lord Ganesha's belly LOL

I am not sure whether I should add this over here or not but I could not resist and I don't know any other way.
I went to a wine shop and was shocked to see cartoon of Ganesha used on the bottle of India Pale Beer. I am not a religious person but this thing made me nervous. Please let me know how this can be protested.

Before EB2 moves faster, every EB3 guy will get a new LC and jump in to EB2 line. Then EB3 line will be little lighter and moves a little faster. Then people will start asking like this - "Can we go back to EB3 line ? Can we have 3rd EB3 LC ( like LC sells in walmart) and another 485 ?" . Pretty much everyone wants to have 2 LC , 2 I-140 and 2 I-485 at any time. That way whichever category moves faster they will beat the system.
Then we come to this forum and wonder why there is so much backlog or why USCIS is so slow ( my favorite one).
This madness has to stop !

I think this letter looks good, let us send it. There is no hassle in doing that.
Questions
1. Do we all need to send a copy? Is this like a campaign we are doing?
2. Do we need to send this as IV? Is that possible? Who should we talk to about that?
3. Has somebody sent such letters before the the DOS Visa Office etc. and got anything - may be they can shed some light. I know of folks who have done the the 7001 form DHS | CIS Ombudsman - Case Problems (http://www.dhs.gov/files/programs/editorial_0497.shtm). I dont think this falls under that.
My 2 cents is - this is not a campaign, we are asking for a formal answer / clarification and if we can send this as from IV may be we will get an answer.

First someone from IV core has to confirm that this rule change does not need congress action. I am sure the core has explored this option before.
Until then, there is no point in having any discussion on this.
I second all , who want to contact USCIS for this. We can take out this from our wish list for a bill.
